Types of trademarks you can register in Hong Kong

The Trade Marks Ordinance Cap. 559 allows registration of several types of marks. Understanding the difference helps you protect your brand at the right level.

Word Mark

No. Any individual or company from any country can apply for trademark registration in Hong Kong. You do not need a local entity. However, a Hong Kong company as the trademark holder provides cleaner IP ownership and is easier to license or transfer.
Hong Kong and mainland China are separate trademark jurisdictions. A Hong Kong trademark only protects you in Hong Kong. To protect your brand in mainland China, you must register separately with CNIPA (China National Intellectual Property Administration). However, your Hong Kong filing date creates a 6-month priority window for China filing.
After publication in the Trade Marks Journal, there is a 3-month opposition window. If a third party files an opposition, both sides present arguments to the Registrar. HEVEA HK will refer you to a qualified IP attorney for representation if an opposition is filed. Most applications face no opposition.
No. The ® symbol can only be used after your trademark is officially registered. Before registration, you may use ™ (unregistered trademark symbol) to indicate you are claiming trademark rights. Using ® on an unregistered mark is a criminal offence under Hong Kong law.
